While addressing a COMDEX
press conference in support of encryption software, attorney F. Lee Bailey said
that such technology would have changed the process in the O.J. Simpson murder
trial.
“There were leaks everywhere, and we didn’t know
where they came from,” he said. “We would gather evidence and read about it in
the newspaper before it even went to the lab.
If we had any encryption software available then we would have been able
to prevent the leaks.”
Bailey was speaking on behalf of APMsafe’s Cypherus
program, which allows users to send secure e-mail attachments, has a secure
database and contains a “digital shredder.”
Bailey said he had been interested in the encryption
field “before many of you were born”, dating back to his own military service.
While the level of encryption in a high-visibility
trial such as the Simpson case is necessarily higher than what’s required for
the average divorce, Bailey feels the average citizen can benefit from the
process.
It is important to prevent any and all leaks, as
there are always unpredictable “mushrooming” consequences when confidential
information is inadvertently released.
“The more people trying to get into the file, the
higher level you need,” he said. “But the average person can benefit from this
too, like if you are a single person and you are balancing two romantic
interests.”
“If the police comes to your house and takes away
your hard drives and they are encrypted, you will not find a judge that will
order you to decode them, as long as it isn’t corporate,” he said. “You have a right to privacy.”
But there are limits.
“If the CIA wants to see what’s on your disk, they
will get in,” he said. “But hopefully that won’t be a problem for the people
who are paying $50 for this particular program.”
